Terms of Service

The agreement between you and GetPhishCheck when you use our phishing email analysis service. Written in plain language. Governed by the laws of Canada.

1. The agreement

These Terms of Service ("Terms") form a legal agreement between you ("you", "your", "Customer") and GetPhishCheck ("we", "us", "our"). By using getphishcheck.com or submitting an email for analysis, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The service

GetPhishCheck is an expert email threat analysis service. You submit a suspicious email file (.eml or .msg), and a cybersecurity analyst reviews it and emails you a written verdict — typically Safe, Suspicious, or Phishing — along with explanation and recommended next steps.

Our target turnaround is 4 business hours from payment. We make reasonable efforts to meet this target, but do not guarantee specific turnaround times. "Business hours" means 9:00 a.m. to 5:00 p.m. Eastern Time, Monday through Friday, excluding Canadian statutory holidays.

Important The service is an analytical advisory opinion. It is not legal advice, regulatory compliance advice, incident response, or remediation. You remain solely responsible for decisions you make based on our verdict.

3. Eligibility & accounts

You must be at least the age of majority in your province or territory of residence, and authorized to use the service under applicable law.

You do not need to create a formal account to submit an email. Where a valid business email address is required, you must provide one you are authorized to use. Keep your email address and any access credentials secure.

4. Acceptable use

When using the service, you agree not to:

  • Submit content you do not have lawful authority to share with us.
  • Submit malware, exploits, or material in a manner designed to damage our systems or circumvent our analysis pipeline.
  • Use the service to harass, defame, or unlawfully surveil any third party.
  • Resell, white-label, or redistribute verdicts without a written partnership agreement with us.
  • Reverse engineer, scrape, or probe the service beyond what is necessary for normal use.
  • Violate any applicable Canadian, provincial, or local law through your use of the service.

We may suspend or terminate access for any violation of these rules.

5. Your submissions

You retain all rights to the content you submit. By uploading, you grant us a limited, worldwide, non-exclusive, royalty-free licence to access, copy, process, and analyze that content strictly for the purpose of delivering the service and operating our infrastructure (e.g., security logs, backups, de-identified aggregate statistics).

We handle your submissions in accordance with our Privacy Policy. In particular, PII is automatically redacted before analyst review, and files are deleted per the retention schedule in that policy.

6. Fees & payment

  • Free Trial: your first analysis is free. One per customer.
  • Pay Per Use: $15 CAD per additional email, charged at submission.
  • Monthly Plan: $99 CAD per month for up to 10 submissions. Unused submissions roll over for 90 days.

All prices are in Canadian dollars and exclude applicable taxes, which will be added at checkout where required. Payment is processed by Stripe; by paying you also agree to Stripe's terms.

We may change pricing on a going-forward basis. Changes do not affect analyses already paid for.

7. Refunds

We want you to be satisfied with the service. If we miss our 4-business-hour target by more than 100% (i.e., take longer than 8 business hours to deliver a verdict for a paid submission), email support@getphishcheck.com and we will issue a full refund for that submission.

Outside of that commitment, refunds are granted at our discretion on a case-by-case basis. Monthly plan fees are non-refundable for the current billing period but can be cancelled any time to stop future billing.

8. Intellectual property

The GetPhishCheck website, brand, verdict templates, reports, documentation, and underlying analysis methodology are owned by us and protected by Canadian and international copyright, trademark, and trade secret laws. Nothing in these Terms transfers ownership of our intellectual property to you.

You may use the verdict reports we deliver to you internally within your organization, including sharing them with your insurer, IT provider, or legal counsel. You may not republish or resell them without our written permission.

9. Disclaimers

Please read carefully THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Cybersecurity analysis involves human judgment over partial information. A verdict of "Safe" is an informed opinion based on available indicators — it is not a guarantee that the email is harmless. A verdict of "Phishing" is likewise an informed opinion.

We do not guarantee uninterrupted availability, error-free operation, or that every threat will be detected. You should continue to operate layered security controls, including endpoint protection, email filtering, MFA, and user training.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not permit the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless GetPhishCheck and its officers, directors, employees, and contractors from any claim, demand, loss, or expense (including reasonable legal fees) arising from (a) your breach of these Terms; (b) your violation of law; or (c) content you submitted that you were not entitled to share.

12. Termination

You may stop using the service at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or if continued provision of the service becomes commercially unreasonable.

Sections that by their nature should survive termination (including IP, disclaimers, liability limits, indemnification, and governing law) will survive.

13. Governing law & disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.

The parties agree to attempt to resolve any dispute informally by contacting support@getphishcheck.com first. If resolution is not reached within 30 days, the dispute will be submitted to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date, and for significant changes we will notify active customers by email where feasible. Continued use of the service after the effective date constitutes acceptance.
